Player Release and Consent Agreement
“In consideration of the acceptance of my entry, I acknowledge the risks associated with participating in UTR Tennis League (“UTR League” or “the league”), accept those risks voluntarily and hereby for myself and on behalf of my heirs and legal representatives release and discharge UTR Tennis League, Universal Tennis, LLC (“Universal Tennis”), the facilities where the Event is held, and all of UTR League’s officers, directors, employees, volunteers, and representatives and Universal Tennis (collectively, the “Released Parties”), of and from any and all claims and demands of every kind, nature and character for any loss, injury, damage, which I or my heir may suffer or sustain, by negligence or otherwise, to the fullest extent permitted by law in connection with any aspect of the Event, including but not limited to any action and/or decision taken regarding the conduct of any matches.
In consideration of the acceptance of my entry, I hereby agree to abide by all applicable rules, regulations, guidelines, and codes of the Event including but not limited to the UTR League and the Referee, or their designee, who will have the authority to take any action he/she deems necessary in the interests of the Event, including but not limited to defaulting a player, without any resulting liability for any of the Released Parties.
In consideration of the acceptance of my entry, I hereby acknowledge and agree that UTR League and Universal Tennis has my permission to use or authorize the use of my tennis match results from the Event to calculate Universal Tennis Rating® numbers and related ratings data (collectively, “UTR Data”), which, along with my biographical identification information, UTR League and Universal Tennis reserves the right to publish on the Internet and elsewhere without limitation and without additional consideration. I further hereby release and discharge UTR League and Universal Tennis of and from any and all claims and demands of every kind, nature and character for any alleged loss, injury or damage which I or my heir may suffer or sustain arising, or alleged to arise, from the publication or use of UTR I am aware of and accept that: (1) The Event is subject to extension and/or cancellation (in whole or in part) due to force majeure or other events as determined by the UTR League in our sole discretion; and (2) The UTR League reserves the right, in our sole discretion, to cancel in whole or in part, for whatever reason, the Event; and, (3) I hereby grant to UTR League, Universal Tennis, and their assignees the right to use or authorize the use of my name, voice, likeness, signature and biographical material without additional consideration for the purpose of publicizing, promoting and advertising the Event and its related parties and/or affiliates, and Universal Tennis, and for the televising, broadcasting (through any and all media) and filming of the same; and hereby grant and assign to UTR League and Universal Tennis and its assignees in perpetuity throughout the world the right to make, use, show and reproduce in any way now known or hereafter devised, for commercial and non-commercial purposes without additional consideration, still pictures, motion pictures, video, sound recordings, posters, live, taped or filmed television taken of me during the Event.
I understand that (1) Entry by my parent, legal guardian, coach, or agent in no way diminishes the application of the above rules, and (2) my participation in any competition at the Event shall be construed as accepting these Terms and Conditions. This Agreement shall be construed in accordance with the laws of the State of California, USA, without regard to its principles of conflicts of laws. Any dispute arising under this Agreement shall be litigated in a federal or state court of competent jurisdiction located within the State of California, USA.”
